What Is Probate?

Probate is the administration of your assets through the probate court. And in a probate, your executor (the person you named in your will) or the administrator (the close relative to you) or other individual who has elected to administer your estate, that person (also called the the personal representative). The personal representative will marshall all your assets, so get them all together and create an inventory and have all of the assets appraised. The personal representative will pay debts, costs of administration out and ultimately they will petition for final distribution telling the court all the money that's been spent for various reasons. Sometimes a personal representative may be required to sell assets. That will also be a power that the personal representative have and be responsibility to do in certain circumstances that the assets needs to be sold. And eventually the personal representative will distribute the assets out to the heirs or beneficiaries.
